Abstract

INDONESIA:

Ada beberapa konsep keadilan dalam hukum pidana, diantaranya adalah keadilan restoratif. Keadilan ini bertujuan untuk mencapai kembali kondisi yang mapan sebelum terjadinya tindak kejahatan baik pada korban, pelaku dan masyarakat pada umumnya. Keadilan prosedural adalah keadilan lain dalam hukum yang berorientasi pada proses. Berbeda dengan keadilan restoratif yang berupaya mengejar hasil perdamaian, keadilan prosedural lebih mengedepankan penilaian tentang perlakuan aparat. Secara teori penilaian keadilan prosedural mengacu pada 3 hal yaitu, penilaian kenetralan, penilaian pada rasa hormat petugas, dan kepercayaan pada petugas.

Tujuan penelitian ini memfokuskan pada upaya pencapaian keadilan restoratif dan keadilan prosedural korban KDRT di Unit Pelayanan Perempuan dan Anak, Polres Malang Kota. Pendekatan dalam metode penelitian adalah kualitatif studi kasus, subyek penelitian sebanyak 3 orang korban tindak pidana kekerasan dalam rumah tangga dengan kriteria purposive. Teknik pengumpulan data menggunakan wawancara, observasi, dokumentasi berupa B.A.P (Berita Acara Pemeriksaan). Pengecekan keabsahan data menggunakan triangulasi dan diskusi dengan teman sejawat.

Keadilan sosial juga memiliki dimensi objektif dan subjektif. Penelitian keadilan dalam psikologi berorientasi pada keadilan subjektif. Hasil penelitian menunjukkan bahwasannya secara subyektif, prosedur dikatakan adil bila mengakomodasi kepentingan individu. Seringkali orang berupaya untuk tidak sekedar mendapatkan keinginannya tapi juga mendapatkan keuntungan yang sebesar-besarnya. Hasil penelitian secara umum menunjukkan subyek penelitian tidak mudah untuk mewujudkan keadilan restoratif, karena kasus telah lama terjadi namun baru melapor kepada pihak berwajib setelah sekian tahun lamanya kasus tersebut terjadi, sehingga dampak fisik dan psikis yang diterima terlampau dalam. Namun dari ketiga subyek merasa keadilan prosedural telah diberikan penyidik kepada pelapor selama proses melapor. Untuk itu penyidik perlu meningkatkan serta memperbaiki sistem peradilan prosedural, karena dari dua keadilan tersebut, yakni keadilan restoratif dan keadilan prosedural, keadilan prosedural lah yang dinilai paling berperan penting bagi korban dalam pengentasan kasus kekerasan dalam rumah tangga, mengingat budaya patriarki yang susah hilang dari mindset masyarakat kita.

There are several concepts of fairness in the criminal law, such as restorative justice. Justice aims to achieve re-established conditions well before the occurrence of crime on victims, perpetrators and the community at large. Another procedural justice is justice in the legal process-oriented. In contrast to the restorative justice seeks to pursue the benefits of peace, justice emphasizes procedural assessment of the treatment apparatus. In theory assessment of procedural justice refers to 3 things, neutrality assessment, the assessment officer respect, and trust in officials.

The purpose of this study focuses on the effort to achieve restorative justice and procedural fairness victims of domestic violence in women's and children's unit, Malang City Police. The approach in qualitative research method is the case study, the study subjects were 3 people crime victims of domestic violence with a purposive criteria. The technique of collecting data using interviews, observation, documentation of B.A.P (Interrogation). Checking the validity of the data using triangulation and discussions with colleagues.

Social justice also has the objective and subjective dimensions. Justice research in psychology oriented subjective justice. Results showed bahwasannya subjectively, the procedure is said to be entirely fair to accommodate the interests of individuals. Often people attempt to not just get his wish but also to benefit as much as possible. The results of the study generally showed research subjects is not easy to achieve restorative justice, because the case has long been going on, but a new report to the authorities after so many years such cases occur, so that the physical and psychological impact received too deep. But of the three subjects felt procedural justice has been given to the complainant during the investigation report. For that investigators need to increase and improve the system of procedural justice, because of the two justice, the restorative justice and procedural fairness, procedural fairness was considered the most important role in the reduction of cases for victims of domestic violence, given the patriarchal
culture that is difficult missing from mindset our society.
